Texas Penal Code § 42.06 makes it a Class A Misdemeanor to knowingly make a false report or alarm that a bombing, fire, offense, or other emergency is occurring when the defendant knows the report is false and expects a governmental or volunteer agency to act. The classic application is a fake bomb threat or a false 911 call. The offense is elevated to a State Jail Felony when the false report involves a public or private school or an institution of higher education. Courts may order the defendant to reimburse the costs of the emergency response.
