Texas Penal Code § 71.02 targets gang and criminal organization activity. A person commits this offense by committing or conspiring to commit almost any serious crime as a member of a criminal combination. The punishment is automatically bumped one degree above the underlying offense — so what would be a Class A Misdemeanor becomes a felony if committed in furtherance of organized crime. Travis County uses this charge against gang members engaged in drug trafficking, robbery, and assault.
