Arson under Texas Penal Code § 28.02 is the knowing or intentional starting of a fire or causing an explosion that damages or destroys property. A standard arson charge is a Second-Degree Felony carrying 2–20 years in prison. The charge escalates to a First-Degree Felony — with a potential life sentence — when the property is a habitation, a place of worship or assembly, or when the fire causes bodily injury or death to anyone. Arson committed to defraud an insurer is also a separate felony under § 28.02(b).
