Texas Health & Safety Code § 365.012 prohibits the unauthorized disposal of litter or other solid waste at any place that is not an approved solid waste site. The offense level scales with the weight or volume dumped: small quantities are a Class C Misdemeanor, while dumping more than 1,000 pounds or disposing of waste for commercial purposes is a State Jail Felony punishable by 180 days to 2 years in state jail and a fine of up to $10,000. Courts commonly order restitution for cleanup and site restoration costs in addition to the criminal penalties.
