Possession of Marijuana in Texas remains illegal under the Texas Health and Safety Code § 481.121. Unlike many states, Texas has not legalized recreational marijuana. Penalties scale with quantity: under 2 ounces is a Class B Misdemeanor (up to 180 days jail, $2,000 fine); 2–4 oz is a Class A Misdemeanor (up to 1 year, $4,000 fine); 4 oz–5 lbs is a State Jail Felony; 5–50 lbs is a third-degree felony; 50–2,000 lbs is a second-degree felony; and over 2,000 lbs is a first-degree felony carrying 5 years to life. Delivery or manufacturing carries enhanced penalties.
