Unlawful restraint under Texas Penal Code § 20.02 occurs when a person intentionally or knowingly restrains another person without their consent. At its base level it is a Class A Misdemeanor, but the charge escalates significantly when the victim is a minor, when the restraint exposed the victim to a risk of serious bodily injury, or when the victim is a public servant. Unlawful restraint is the lesser-included offense of kidnapping (§ 20.03) and often appears in domestic violence, custody dispute, or altercation contexts in Travis County bookings.
