⚖️ Texas Law — Charge Details
Up to 1 year jail + $4,000 fine (Class A)
Failure to Identify under Texas Penal Code § 38.02 requires a person who is lawfully arrested or detained to provide their name, date of birth, and residence address on request by a peace officer. Refusing to provide this information while lawfully detained (but not arrested) is a Class C Misdemeanor. Giving false information while arrested or detained is a Class B Misdemeanor. Giving false information while a fugitive from justice — the most serious variant — is a Class A Misdemeanor. A peace officer may not compel a person to provide identification simply for being present in a public place without reasonable suspicion.
