Indecency

Indecency with a Child under Texas Penal Code § 21.11 prohibits engaging in sexual contact with a child under 17 years old, or exposing one's genitals to a child under 17 with intent to arouse or gratify sexual desire. Sexual contact is a Second-Degree Felony (2–20 years); exposure is a Third-Degree Felony (2–10 years). Both require lifetime sex offender registration upon conviction. The offense does not require physical touching for the exposure variant — communication or presence with intent is sufficient. A 'Romeo and Juliet' affirmative defense may apply in very limited circumstances when the defendant is no more than three years older than the child.
