An Application to Revoke Probation (also called community supervision) is filed by the State when a probationer allegedly violates the terms of their supervision. Unlike a criminal trial, a revocation hearing is conducted before a judge with no jury, and the State need only prove the violation by a preponderance of the evidence — a lower standard than beyond a reasonable doubt. If the judge finds a violation, probation can be revoked and the defendant sentenced to any term up to the maximum for the original offense.
